At Circular Clothing Co., we connect buyers with independent sellers offering quality second-hand fashion. Each item is listed, described, and shipped directly by the seller. Because every piece is unique, we aim to ensure listings are accurate and buyers know exactly what they’re purchasing.
Circular is a marketplace connecting buyers with independent sellers, including resellers and individuals. Items listed on Circular are not sold by Circular directly — each seller is responsible for their own listings, descriptions, and fulfilment.
Because of this, standard retail return policies may not apply in the same way as purchases made from a traditional retailer. Where a seller is operating as a business, your rights under the Australian Consumer Law will apply. Where a seller is not operating as a business, certain consumer guarantees may not apply in the same way.
This policy explains how returns, refunds, and disputes work when buying from sellers on our marketplace.
Circular facilitates transactions between buyers and sellers and may step in where required to review and determine outcomes, ensuring fair and consistent resolutions for both buyers and sellers.
Nothing in this policy excludes or limits any rights that cannot be excluded under Australian Consumer Law.
1. All Sales Are Final (Unless Misrepresented)
Because items are second-hand and sold by independent sellers, all sales are final except in the following cases:
A return/refund may be approved when:

The item you received is significantly misrepresented, or
-
You received the wrong item, or
-
Your parcel was not delivered (lost in transit).
“Change of mind” returns are not accepted.
2. What Counts as Misrepresentation?
An item is considered misrepresented if it is materially different from the listing. Examples include:

Wrong size, brand, or model

Obvious defects or flaws not shown or mentioned

Incorrect condition rating

Fake, counterfeit, or inauthentic goods
-
Measurements significantly inaccurate
-
A different item entirely
Minor wear consistent with second-hand items (e.g., light pilling, small wash fade) does not qualify as misrepresentation unless it was major or undisclosed.
Minor variations in colour due to lighting, photography, or screen display differences are not considered misrepresentation.
3. How to Report an Issue
If something isn’t right, please contact us within 48 hours of delivery at:

Include:
- Your order number
- Photos of the item
- Description of the issue
We will review the case and coordinate directly with the seller to reach a resolution.
4. Resolution & Disputes
Buyers and sellers must first attempt to resolve the issue through the Circular platform.
If that fails, Circular may:

Refund the buyer

Debit or withhold equivalent funds from the seller’s connected account

Make a final determination based on our Dispute Policy and Terms of Service
Circular’s determination is final within the platform but does not affect your rights under Australian Consumer Law.
5. Returns Shipping
If Circular determines that a return is required:
If the item was misrepresented or incorrect:
- The seller is responsible for return shipping costs
- The buyer must return the item to the seller’s nominated address
Returns must be sent using tracked postage. Buyers must provide tracking details once the item has been dispatched.
If Circular determines the item was accurately described:
- No return is required
- No refund is issued
Buyers are responsible for packaging items securely when returning them.
6. Refund Method
When a refund is approved:

Refunds are processed to your original payment method

Refund timing depends on Stripe or PayPal’s processing speeds

Any embedded shipping cost is not refundable unless the item is misrepresented or incorrect.
Store credit is not issued for marketplace purchases.
7. Items Not Eligible for Return
Returns are not accepted if:

The item matches the photos and description

The buyer changed their mind
-
The buyer ordered the wrong size
-
The item shows normal second-hand wear already disclosed

The return request is made outside the 48 hour business window

The item has been worn, damaged, or altered after delivery
Individual sellers may offer more flexible return options at their discretion, but this is not required.
8. Lost or Damaged Parcels
If your item is lost or significantly delayed:

The seller must cooperate with the carrier (e.g., Australia Post)

Buyers must notify Circular within 10 days of the expected delivery date

Circular may refund the buyer and deduct funds from the seller once loss is confirmed
If an item arrives damaged due to shipping, please provide photos of:

The item
-
Interior and exterior packaging

Any relevant carrier labels
Damage caused during transit must be reported within 48 hours of delivery.
9. International Orders
The same marketplace rules apply:

All sales are final except misrepresentation or wrong item

Return shipping is the seller’s responsibility for approved returns

Buyers are responsible for any customs fees paid on their side (non-refundable)
