Seller Guidelines

Welcome to Circular Clothing Co. (“we,” “our,” or “us”). These Seller Guidelines (“Guidelines”) apply to all individuals or businesses (“you,” “seller,” or “sellers”) who list and sell items on our marketplace at circularclothingco.com.au (the “Platform”).
Circular is a curated secondhand fashion marketplace featuring pre-approved sellers and wardrobes that meet our quality, authenticity, and sustainability standards
By listing items on Circular, you agree to follow these Guidelines, our Terms of Service, Privacy Policy, and Shipping & Dispute Policy. These rules exist to maintain trust, authenticity, and a safe experience for everyone using the Circular marketplace.
1. Seller Eligibility
Circular operates a curated marketplace. Not all applicants are accepted.
Sellers may be:

Approved via application

Invited by the Circular team
-
Onboarded through partnerships or programs
We reserve the right to approve, decline, or remove sellers based on quality, authenticity, performance, or alignment with Circular’s brand values.
Sellers operate as independent merchants. Circular provides the platform but does not take ownership of listed items unless explicitly stated.
2. Seller Responsibilities
Sellers are responsible for maintaining honest, accurate, and high-quality listings.
You must:

Provide clear, complete, and truthful listing information

Include accurate sizing, condition, and brand details

Disclose all faults, wear, or alterations

Communicate respectfully with buyers

Dispatch sold items within 3 business days
-
Upload valid tracking once shipped
-
Respond to enquiries or disputes via the Platform
Repeated delays, misleading listings, or poor communication may affect visibility, payouts, or account status.
3. Listing Quality Standards
To maintain consistency across the marketplace and help customers shop with confidence, all listings must meet Circular’s quality standards.
Sellers should:

Use clear, well-lit photos of the actual item

Capture key angles (front, back, tags, fabric, flaws)
-
Avoid heavy filters that alter colour or condition
-
Present items clean, wrinkle-free, and neatly styled
-
Include measurements where possible
Stock or model images may be used only as secondary references.
Listings that don’t meet these standards may be hidden or removed until corrected.
4. Item Condition Standards
To maintain transparency, all sellers must assign an accurate condition rating to each item using the categories below.
Listings with missing or misleading condition information may be removed or adjusted.

Gently worn item in excellent overall condition. Minor wear such as light fading, minimal pilling, or faint surface marks may be present. |

Pre-loved item showing moderate wear such as fading, small stains, or pilling that does not affect wearability or structure. |

Acceptable |
Noticeably worn but functional item with visible flaws (e.g. fading, marks, small holes, stretched fabric). Should be clearly described and priced accordingly. |
Sellers must:

Choose the most accurate category that reflects the item’s true state.

Disclose all flaws in the description and include close-up photos.
-
Avoid describing items as “like new” or “perfect” if any visible wear exists.

Remember: transparency protects your reputation and builds buyer trust.
5. Pricing & Fees
Circular charges a 12.5% commission on successful sales.
Sellers must not manipulate pricing (e.g. inflating shipping to offset fees).
Price Integrity & Promotional Transparency
To maintain trust across the marketplace, sellers must ensure pricing reflects genuine value.
Artificial price inflation prior to promotions is not permitted. This includes temporarily increasing item prices in the lead-up to platform sales, campaigns, or seller-run discounts in order to create the appearance of larger markdowns.
As a general guideline, sellers should avoid materially increasing prices within 10 days before participating in a promotion unless the change reflects genuine market value (e.g. new information about the item, re-evaluation of condition, or pricing corrections).
Circular reserves the right to:

Adjust or exclude listings from promotions

Remove misleading discounts
-
Limit visibility of listings that appear artificially inflated

Take action against repeated manipulation of promotional pricing
Our goal is to maintain a fair and transparent marketplace for both buyers and sellers.
Sellers may offer:

Free shipping
-
Discounts or bundles
-
Promotional pricing
Payments are processed via integrated third-party providers (e.g. Stripe Connect or PayPal).
Payouts are typically issued after an order is marked delivered. Circular may place temporary holds on payouts in cases of disputes, returns, fraud checks, or policy reviews.
Offers & Negotiation
Circular may enable features that allow buyers to submit offers on listings. Sellers retain full control over accepting or declining offers.
Submitting or receiving an offer does not reserve the item. Listings remain available for purchase until an order is completed through checkout.
At present, offers remain open until the seller takes action. Sellers are encouraged to review offers promptly, as timely responses improve buyer engagement and conversion.
Sellers are encouraged to review and respond to offers within 48 hours, as timely responses help maintain a positive buyer experience.
Circular may introduce additional safeguards (such as offer expiry windows) over time to support a healthy marketplace.
6. Shipping & Fulfilment
Sellers are responsible for packing and shipping their own items unless otherwise agreed.
You must:

Ship within 3 business days

Provide tracking for all orders

Use secure, protective packaging
Insurance is recommended for high-value or fragile items.
If a parcel is delayed or lost, refer to our Shipping & Dispute Policy. Sellers must cooperate with buyers, couriers, and Circular to resolve delivery issues.
7. Listing Assist & Platform Services
Circular may offer optional services such as Listing Assist, photography support, or merchandising guidance to help sellers create higher-quality listings.
These services are provided to support sellers and do not transfer ownership or responsibility of any items to Circular.
Unless explicitly agreed in writing:

Sellers remain responsible for authenticity, pricing, and listing accuracy

Circular does not guarantee sales outcomes or pricing performance
-
Final approval of listings remains with the seller
Circular may introduce, modify, or discontinue platform services over time.
Promotional offers (including free or discounted services) may be introduced from time to time and are subject to separate terms, eligibility criteria, and availability. Unless otherwise stated, promotional services are non-transferable and non-refundable.
8. Prohibited & Restricted Items
The following items are not permitted on Circular:

Counterfeit or misrepresented branded goods

Stolen or illegal items
-
Hate, discriminatory, or violent materials
-
Explicit adult content
-
Items containing real fur, ivory, or endangered materials
-
Weapons, explosives, or hazardous goods
-
Unsafe or unhygienic items
-
Listings that conflict with Circular’s values
Replicas, Dupes & Inspired-By Items
Replica or “dupe” items are permitted only if:

Clearly disclosed in the description
-
Brand set to “Other”
-
No misleading use of trademarks or logos
Misleading branding may result in removal or suspension.
Intimate Apparel & Swimwear
These items may be listed if:

Clean and hygienic
-
Presented respectfully
-
Focused on fashion, not adult context
Circular may remove listings that appear explicit or unsanitary.
9. Authenticity & Brand Integrity
All branded items must be genuine.
Sellers are responsible for verifying authenticity before listing. Circular may request proof of purchase or authentication at any time.
Listings found to be counterfeit or deceptive will be removed. Repeated authenticity concerns may result in permanent removal from the marketplace.
10. Seller Conduct
We expect all sellers to contribute positively to the Circular community.
Sellers must:

Treat buyers and staff respectfully

Avoid harassment, discrimination, or abusive behaviour

Not attempt off-platform sales (“fee avoidance”)
-
Comply with applicable laws, including tax and consumer law
Sharing contact details, payment links, or directing buyers off-platform may result in immediate suspension.
Circular may adjust listing visibility based on seller performance, dispatch speed, or policy compliance.
11. Sustainability Standards
Circular prioritises longevity, reuse, and waste reduction.
Sellers should ensure items are:

Clean and wearable

Suitable for continued use
-
Presented in alignment with Circular’s sustainability values
We encourage recycled or minimal packaging where possible.
12. Enforcement
Circular may:

Remove listings
-
Issue warnings
-
Limit visibility or payouts
-
Suspend or terminate accounts
Severe breaches — including fraud, counterfeiting, or harassment - may result in immediate removal without notice.
Sellers may appeal enforcement decisions by contacting hello@circularclothingco.com.au within 7 days. Decisions are final.
13. Updates
These Guidelines may be updated from time to time. Updated versions will be posted on the Platform. Continued use of Circular constitutes acceptance of the latest version.
